13 At any point in the Silent Auction, guests may tap the "My Items" button on their device to view which items they are winning or losing. Guests may also tap the "Bid" button to re-bid on a lost item, or may resubmit another max bid manually. No bidding on items will be allowed after the Silent Auction is closed. When the auction closes, the winning bid for each item will be viewable from your handheld device. Successful bidders will be notified via their handheld device at the end of the Silent Auction. Your card will not be charged unless you win an auction item. An announcement will be made prior to the end of the Silent Auction. The Development Office staff reserves the right to adjust the closings of categories on the night of the Gala. After payment is made, merchandise and gift certificates can be claimed in the Merchandise Distribution area. Information on Tax Deductibility of Auction Purchases Purchases made at Gala 2017 are tax-deductible as provided by law only to the extent that the purchase price exceeds the fair market value of the merchandise. General Rules Neither Latin School nor the auctioneer assumes responsibility for the validity of any description, authenticity, or condition of any item offered or makes any warranty or guarantee. All property is sold "as is." Values of merchandise donations shown on 501 Auctions devices, this catalog, or other Gala materials are estimates of fair market value, as stated by the donor or determined by the Gala Chairs, and are not warranted by Latin School for tax or other purposes. All sales are final. Latin School is not liable for any refunds or exchanges. Most certificates and merchandise are not exchangeable for cash in part or in full and are non-transferable. Most items are not exchangeable once purchased. Hotel, air, transportation, and restaurants are subject to availability. Unless otherwise specified, all certificates expire March 4, 2018. Items and/or services purchased at the Gala are not intended to be sold or auctioned at a later date by the buyer. By making a purchase, the buyer waives any claims for liability against either Latin School or the donor of property services. Neither Latin School nor the donor is responsible for any personal injuries or damage that may result from the use of property services sold. Latin School reserves the right to (a) withdraw any item at the time before actual sale and (b) reject a bid from any bidder. Faculty services may be redeemed by current Latin School families only. With the exception of the Live Auction, the Development Office staff will act as the final authority on any bidding disputes.
